Competences Products – market access & liability

Product law, which consists of complex, interdisciplinary regulations, is dominated by European legislation. Its main elements consist of the requirements applying to environmentally compatible product design as well as safety regulations and questions of product responsibility. Central aims include the harmonisation of the Single European Market and the removal of market barriers. While technical standardisation plays an important role in this context, such standardisation also faces major challenges due to ever shorter innovation cycles.

Responsible economic operators must ensure compliance with the generally extensive legal requirements applicable at the time of market launch. Liability risks arise not only due to market monitoring measures. Consequences under competition law as well as contractual and product liability claims arising in the supply chain or asserted by consumers illustrate the need for an adequate product compliance organisation.

We advise well-known manufacturers of building products, machinery, electrical and electronic equipment, medical devices and consumer products as well as manufacturers in the automotive and other industries. Moreover, we are active in corresponding areas on behalf of importers, wholesalers and major trade associations. Questions concerning conformity assessments or constancy of performance verifications, CE marking, material compliance (REACH, RoHS, CP 65 etc.), registrations under electrical and electronic equipment law, packaging law and battery law and the interface between product design, resource efficiency, substance law and waste management are just as much a focal point of our activities as the drafting of contracts in compliance with product law. At the same time, we also focus on future topics such as smart textiles, the Internet of Things, cyber security and artificial intelligence. We are actively involved in shaping the product regulation framework.
